Breach of Environmental Management and Pollution Control Act 1994
On 4 May 2020 Huon Aquaculture Company Pty Ltd was fined $40,000 in the Hobart Magistrates Court for one charge of depositing a pollutant in a place where it could reasonably be expected to cause material environmental harm and five charges of contravening conditions of its Environment Protection Notice at its Whale Point net wash facility in early 2018. Huon Aquaculture had pled guilty to the charges which were laid under the Environmental Management and Pollution Control Act 1994.
The Court made no finding of environmental harm and commented that this was not a case where it was alleged that Huon Aquaculture offended to actively avoid environmental regulations. The Court noted that Huon Aquaculture had taken active steps to improve processes in order to avoid future breaches.
Huon Aquaculture has apologised for and regrets the circumstances that resulted in the charges being laid and is committed to protecting the environment and working towards Tasmania’s environmentally sustainable future. Huon Aquaculture is committed to complying with the State’s environmental regulations.
The 5 May post on the Huon Aquaculture Facebook page and webpage contained unwarranted comment and has been removed from publication. Huon Aquaculture stands by the formal apology that was given in Court on 4 May 2020.
